1. Introduction

Welcome to Speech Up LLC’s online platform (the “Platform”), which facilitates therapy services. This website is managed by Speech Up LLC, also known as Speech Up, located at 500 Westover Dr. #11458, Sanford, NC 27330 (info@speechup.org). The Platform may be accessible through various websites or applications, including speechup.org and related apps.

By using the Platform, you agree to these Terms of Use (the “Agreement”). Please review these terms carefully. If you do not agree to any part of this Agreement, do not use the Platform.

References to “we,” “us,” or “our” pertain to Speech Up LLC or any entity operating the Platform (collectively, the “Company”).

2. Therapists and Therapist Services

The Platform connects you with Therapists who offer services through it (“Therapist Services”).

For U.S. Therapists:

  • Therapists must be licensed speech-language pathologists (CCC-SLP) or hold a similar certification recognized in their state or jurisdiction.
  • They must possess a relevant degree, at least three years of experience, a minimum of 1,000 hours of hands-on practice, and certification from their professional board.

For U.K. Therapists:

  • Therapists must be registered with the Health and Care Professions Council (HCPC) or hold similar recognized certification.
  • They must have a relevant academic degree and a minimum of three years of experience, with proper accreditation from their professional organization.

Therapists are independent providers, not our employees or agents. Our role is limited to facilitating the Therapist Services. If you are dissatisfied with a Therapist, you may switch to another available Therapist. If a Therapist leaves the Platform, we will notify you and assist in finding a new Therapist.

While we aim for the Therapist Services to be beneficial, they might not suit everyone’s needs or replace in-person evaluations or care.

3. Privacy and Security

We prioritize the protection of your information. For details on our privacy practices, refer to our Privacy Policy at speechup.org. By using the Platform, you agree to the terms of the Privacy Policy, which is part of this Agreement.

4. Third-Party Content

The Platform may include content, products, services, or links from third parties (“Third Party Content”). We are not responsible for the creation, accuracy, or quality of Third Party Content and are not liable for any related damages or losses.

5. Disclaimer of Warranty and Limitation of Liability

The Platform is provided “as is,” with no warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, non-infringement, or fitness for a particular purpose. Use of the Platform is at your own risk.

We are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages. Our total liability for any claims related to this Agreement or the Platform is limited to the amount paid by you through the Platform in the 12 months before the claim. This limitation may be adjusted if required by applicable law and will survive the termination of this Agreement.

6. Account Responsibilities and Conduct

You confirm that you are legally capable of consenting to receive services or have appropriate consent, and that all information provided on the Platform is accurate, current, and complete. You are responsible for maintaining the confidentiality of your account information and will notify us of any unauthorized use.

You agree not to use another person’s account, misuse the Platform, or engage in any prohibited activities, including but not limited to unauthorized access, spam, or illegal content. You agree to indemnify us against any claims arising from your use of the Platform.

You must use only valid payment methods and provide accurate payment information. By subscribing, you authorize automatic billing according to your selected plan. Contact us within two months of a payment for any issues. Refunds are not given for missed sessions, and you can pause your account for up to two weeks every two months.

7. Platform Modifications and Interruptions

We may modify, suspend, or discontinue the Platform at any time, with or without notice. We are not liable for any disruptions or issues resulting from these actions or from factors beyond our control.

We may send notices to you via email, regular mail, or by posting on the Platform. Notices sent to us should be directed to info@speechup.org

9. General Terms

This Agreement is governed by the laws of the State of New Jersey, excluding choice of law rules. Any legal proceedings must be conducted in the U.S. District Court for New Jersey or state courts in Burlington County, New Jersey. This Agreement constitutes the entire agreement between you and us. Any changes to the Agreement will be posted on the Platform and become effective immediately. Continued use of the Platform signifies acceptance of the revised terms.

We may transfer or assign this Agreement. Headings are for convenience only and do not affect interpretation. If any provision is found to be invalid or unenforceable, the remaining provisions will still apply. Liability limitations and indemnifications will survive the Agreement’s termination.
